Detailed Rules for the Implementation of the Access of Institutions to the Beijing China-Germany Industrial Park

The Beijing China-Germany Industrial Park, as an important area in the development of the Integrated National Demonstration Zone for Opening Up the Services Sector and the China (Beijing) Free Trade Pilot Zone, is positioned to be built into “a clustering area of German advanced manufacturing industries, a strategic highland for the development of hidden champions in China and Germany and an important window of China-Germany communication and open innovation” with focuses on key fields including new energy intelligent vehicles, intelligent equipment, industrial Internet, sci-tech services, business exhibition and digital trade. The starting area of the Industrial Park, with the China-Germany Plaza as the core industrial supporting structure, will mainly welcome and develop a cluster of German hidden champion enterprises and cultivate a number of R&D, preliminary and pilot study, testing and verification, system integration and other technology service platforms. For the purpose of further regulating the access of institutions to the Beijing China-Germany Industrial Park, rationally allocate resources and factors, selecting high-quality projects, improving the quality and level of introduced projects, implementing the construction tasks of Shunyi District in the development of the Integrated National Demonstration Zone for Opening Up the Services Sector and the China (Beijing) Free Trade Pilot Zone and promoting China-Germany economic and technological cooperation and communication, the Detailed Rules are developed in accordance with current policies of Shunyi District and in light of the actual circumstances of the Industrial Park. 


I.Applicable Entities

The Detailed Rules shall apply to foreign wholly-owned and joint-venture corporations or institutions with German and European direct investment and corporations or institutions in cooperating with Germany in key projects, technologies or talent, including sci-tech enterprises, R&D institutions and institutions offering sci-tech services.


II.Criteria for Access


1. In line with the industrial policies of the state and Beijing Municipality.


2. In line with the requirements of the development of the Integrated National Demonstration Zone for Opening Up the Services Sector and the China (Beijing) Free Trade Pilot Zone and the orientation of leading industries of the Shunyi District.


3. In line with the conditions of work safety prescribed by laws, regulations and industrial standards and adopting production techniques that comply with requirements in safety, fire prevention and control, health and environmental protection.


4. In principle, projects registered shall be headquarters of related corporations; those that cannot be registered as headquarters shall be registered as subsidiaries which keep separate accounts. Project owners shall have their business registration, tax registration, tax location, statistical relation and property right holders located in Shunyi District, maintain standardized operation and strong financial performance, and have no records of violations on laws or regulations in operation, taxation and credit since registration.


5. Project output efficiency: after the project reaches its capacity, annual output shall be not less than 25,000 yuan per cubic meter or annual tax paid shall be not less than 1,500 yuan per cubic meter. Innovation capabilities: production equipment, techniques and technologies of the project shall reach international or domestic industrial advanced levels, core technology of its major product (service) shall own at least one intellectual property right and have no intellectual property right dispute; the project owner shall be able to make continuous investment in R&D.


6. Priority access projects: national R&D centers, innovation center, technology centers and key labs that imply with the orientation of leading industries of Shunyi District; the investor is a World Top 500 Enterprise, a German hidden champion enterprise, a European-invested or joint-venture enterprise or an international business body of a China Top 100 Enterprise and the enterprise is registered and taxed in Shunyi District; the investor is a German or European advanced R&D institution, innovation center or its representative office in China or in Beijing; the amounts of project investment and tax paid exceeds 50 percent of the minimum standards in the Shunyi District; key members of the investor are German industrial leaders or professional talents, or high-tech talent and innovation teams from home and abroad, or the project is a “major national science and technology project” with core and crucial technologies and independent intellectual property rights; the investor is able to integrate and make full use of resources including inventory land and factory spaces and the project owns national patented technologies and high science and technology content; the industrial service institutions and sci-tech innovation platform institutions that can promote China-Germany and China-EU industrial cooperation and sci-tech innovation cooperation.


III.Settling Process


1.Application acceptance and preliminary review

The Tusholdings China-Germany Industrial Park Operation Company is responsible for preliminary tracking and connection of resources of a project and inquiries from the project owner and assisting in filling out and accepting the application form (see Annex 2) and feasibility report upon good consulting and communication; and the preliminary review shall be finished within three workdays.


2.The Grade-1 Review (defense session)

After the project passes the preliminary review, the Tusholdings China-Germany Industrial Park Operation Company shall set up an expert review group for the project according to related field of the project (core members shall include experts in related industries and technological fields from major institutes or research centers such as Tsinghua University, from the Shunyi District Economy and Information Technology Bureau, from competent departments of related projects and territorial regulatory bodies of the settling location of the project, and in the Tusholdings expert database); the result of the Grade-1 Review shall, in accordance with the standardized process, be reported to the Shunyi District Economy and Information Technology Bureau within two workdays.


3.The Grade-2 Review (internal review)

After the project passes the Grade-1 Review, the Shunyi District Economy and Information Technology Bureau shall send conclusive opinions of the Grade-1 Review to the territorial regulatory bodies of the settling location of the project who will conduct the Grade-2 Review. For those in line with current policies of the Shunyi District, all related departments shall finish the review within two workdays and send the feedback to the Tusholdings China-Germany Industrial Park Operation Company who has the right to offer office space rental subsidies of not more than 5 years for related project according to specific condition; for those not complying with current policies of the Shunyi District, all related departments shall issue an opinion within 5 workdays and send it to the Tusholdings China-Germany Industrial Park Operation Company.


4.The Grade-3 Review (joint meeting of government departments and reporting of Tusholdings)

For a project not complying with current policies of the Shunyi District, the Tusholdings China-Germany Industrial Park Operation Company shall gather materials and report to a joint examination meeting of Shunyi District government departments for deliberation (in principle the meeting shall be arranged at least once every month and can be summoned randomly on the basis of the work needs); the review process of the project shall be finished based on the results of the deliberation and the feedback shall be given to the Tusholdings China-Germany Industrial Park Operation Company.


5.Signing the settling agreements

Upon approval of the project, the Shunyi District Economy and Information Technology Bureau, the Tusholdings China-Germany Industrial Park Operation Company and the territorial regulatory bodies of the settling location of the project shall, according to agreement signing procedures, sign the Agreement on Settling in Beijing China-Germany Industrial Park, the Rental Agreement of China-Germany Plaza and the Letter of Operation Targets Liabilities of Settling Institutions Settling in Beijing China-Germany Industrial Park (see Annex 3).


IV.Assessment and Exit Mechanisms


1.Establishing assessment system

The assessment method shall be formulated and improved jointly by the Shunyi District Economy and Information Technology Bureau, the Tusholdings China-Germany Industrial Park Operation Company. The Shunyi District Economy and Information Technology Bureau is the competent authority of the assessment work of institutions applying for settling in the Industrial Park, the Tusholdings China-Germany Industrial Park Operation Company and the territorial regulatory bodies of the settling location of the institution shall be the entities in charge, and the three parties shall joint be responsible for specific work of establishing the assessment system, setting assessment targets, conducting assessments and evaluations and dealing with the assessment results.


2.Setting assessment targets

Assessment targets shall, based on the related agreements between institutions settling in the Industrial Park and the Shunyi District Economy and Information Technology Bureau, be classified into sci-tech enterprises, R&D institutions and sci-tech service institutions. The Shunyi District Economy and Information Technology Bureau shall guide the Tusholdings China-Germany Industrial Park Operation Company and the territorial regulatory bodies of the settling location of the institutions to set specific assessment targets, rationally design assessment points system and formulate the assessment schemes.


3.Conducting assessment and evaluation

Assessments shall be carried out every year. Institutions settling in the Industrial Park shall be evaluated in a comprehensive manner according to assessment targets and related points system, and the results shall be “fail” or “pass”.


4.Use of assessment results

For those institutions applying for settling that fail the assessment shall face the halt of supporting favorable policies to be enjoyed and shall be required to state the reasons in writing and make rectifications within a prescribed time limit. Those institutions that fail two consecutive assessments shall move out of the Industrial Park within one month of the announcement of assessment results.


V.Requirements


1. Signing agreements. It is clearly agreed that the institution applying for settling in the Industrial Park shall, upon approval of access, sign with the Shunyi District Economy and Information Technology Bureau, the Tusholdings China-Germany Industrial Park Operation Company and the territorial regulatory bodies of the settling location of the institution, the Agreement on Settling in Beijing China-Germany Industrial Park, the Rental Agreement of China-Germany Plaza and the Letter of Operation Targets Liabilities of Settling Institutions Settling in Beijing China-Germany Industrial Park, where all basic matters of the project are clearly stated as the basis for future assessment, monitoring and management.


2. Authentic declaration and strict examination. The institution applying for settling in the Industrial Park shall provide application materials according to facts. In the case of providing false information, the assessment application qualification or the assessment results of the project shall be canceled; authorized assessment entities or individuals shall be responsible for related assessment application materials and shall be liable for any behavior of falsifying or concealing information; a project that has not finished all reviews or fails the assessment shall not be provided rental properties and no department of the Shunyi District People’s Government may handle any approval formalities without permission.


3. Service improvement and process optimization. For any institution with access approval, the Tusholdings China-Germany Industrial Park Operation Company shall be responsible for the service and guidance throughout; the Shunyi District Economy and Information Technology Bureau shall be responsible for the coordination of related government departments and territorial regulatory bodies of the settling location of the project in finishing all necessary procedures within prescribed time limits, so as to provide a good business environment and to ensure the implementation of the project.


VI.Supplementary Provisions


1. For projects that are crucial to the economic and social development of the Shunyi District, able to improve the image of regional industries and improve the industrial levels, and play an important role in driving the industrial development, the policy of “Case by Case” will be adopted upon approval of the Shunyi District Economy and Information Technology Bureau.


2. The Detailed Rules shall be subject to interpretation by the Shunyi District Economy and Information Technology Bureau and shall come into effect on the date of issuance. In the case of any discrepancy between the provisions of related documents and the Detailed Rules, these Detailed Rules shall prevail.
